Theresa Torres, suspect in the Amiel Alcantara death to be arraigned in court on Thursday, March 12

we heard that theresa torres, the ateneo mom who was involved in the tragic death of grade 4 student amiel alcantara will be arraigned in court this thursday, march 12.

we are guessing she is facing several charges – the death of amiel, the injuries on the nanny and the injuries on the two siblings of amiel. there can be others like the damages on the cars but the car owners and not the alcantaras are involved on that one.

the alcantaras are making an appeal to parents, drivers and students who witnessed the accident to come forward to give better light to the incident.

there are two families inolved here – the alcantaras and the torres. both families are grieving and in pain. torres  has a son who is also in grade 4 just like amiel was. her son has not gone back to school which is of course understandable.

we need to look at this incident with an open mind as the wheels of justice turn and hopefully as justice is eventually served.

I post this as an observer during the arraignment proceedings held this morning, 12 March 2009 at Branch 107 at the QC City Hall of Justice. I am not a lawyer and do not pose as one. I am a mere observant and commentator.

The scheduled arraignement began at 8:36am. The judge entered and all were asked to rise. Two other cases where first heard then finally our much awaited case was on by 9am. As in any other case, the complainant and defense are asked to identify themselves. I am surprized how the accussed Mrs. Torres deliberately softens her voice and tries to misleads the court with regards to her name. The case was filed against her on March 25, 2008 and she then gave her name as Ma. Theresa Songco Torres. When asked by the judge questions (just re-phrasing the previous identity question) she says something else. She says she is Ma. Theresa Torres Laki. The judge, perplexed by her soft voice asks her counsel to produce proofs of her identity such as passport and marriage certificates. She claimed to be a single parent yet she said she has a marriage certificate. Live in? A mistress perphaps of a known figure? Obviously, there was no Mr. Laki around to accompany her. There where two men sitting behind her, maybe a brother and/or father. I have information on Mr. Laki but I reserve this for my future postings. I have to make sure first.

As a non-legal observer of the proceedings, I asked myself. How can she not answer the judge outright by stating her full name? My prep nephew and niece can answer that quesiton in seconds, and they both have very looooong full names? What are you hiding from us Theresa? Why do you deliberately mislead the questioning right from the begining on the night after the killing of my nephew? Cant you face your accussers?

I would like to comment on the defenses’ motion to “quash” certain issues of the case. But I am not an authority on this. Just this for now. You may view my next videos of the arraignment on my youtube.com account. Search for mmnMoreno.

Thank you doc Martin for the insider’s view of what happened today. I’ve been passionately following the news about Amiel. My son is his batchmate and like many other parents, I have been very affected with what happened. I always had tears in my eyes whenever I heard or read about the accident. The wound created by this tragedy has really cut me deep…
This post really gives us an insight as to the character of Torres aka Laki…expect more legal tricks…I wish all those who are praying for her, pray more strongly for her to speak of nothing but the truth from hereon, if indeed she has true remorse.

I know the history of the Couple Mr. and Mrs. Laki, yes she is married, yes they are separated, not divorce niether annuled in short they dont live together anoymore, Mr. Laki is honest man, he is not that famous, the wife, her family is famous in a small town in pampanga, some people see them so arrogant, “matapobre” , this was the cause of the separation, beause of the high standards of the wife’s family, Mr. Laki was not that rich and famous. Maybe that is why she is ashame of using her real surname.

In my opinion, for her children’s sake it was good that she used her maiden name especially as the accident was widely covered by the media. In so doing she was able to protect the identities of her children.. especially her son who is also a Grade 4 student.

    Hi Wawam

Perhaps there are things better left unsaid/unposted esp. events in a court hearing.

    • March 12, 2009 at 3:45 pm

we accept most of the postings here on any topic. we hardly delete or disapprove postings.

postings like the above are acceptable, those are things you will probably read in the newspapers tomorrow or see on tv later tonight.

why should events in a court hearing be not posted? did the judge issue a gag order?

aren’t all court hearings public hearings unless otherwise stipulated? and it has to be stipulated for good reason. things like national security come to mind.

    ?

after all, how can both parties be assured of a fair hearing if the hearing was private?

“…Live in? A mistress perphaps of a known figure? …”

“…why should events in a court hearing be not posted? did the judge issue a gag order?…”

Just so that the trial does not become a media circus. After all, at least two Ateneo families are hurting.

Anyway, if you guys feel there should be maximum transparency, then fire away…

I’m not a lawyer but I’ve talked to a friend of mine who is one and he said as long as the merits of the case are not being discussed then its okay. Besides, doc Martin was telling us about what he observed inside the court, which includes the demeanor of Torres aka Laki. What he shared with us just had more details as compared to the evening news. It’s really disappointing that with the current legal move of this woman she still does not accept any responsibility for what she did. I guess its still her vehicle that she continues to blame.

In the news last night it was reported that a truck driver ran over 3 college students in front of their school in Cavite. I have more respect for the driver of this truck because right after the accident he surrendered to the police and asked forgiveness for what happened, with genuine sincerity and remorse. A far cry from how Torres-Laki has acted all through these. I pity her son more because aside from being exposed now as her son by revealing his surname, the boy has to live his life knowing that his mom killed his batchmate and refuses to acknowlege any fault.

You are a keen observer I know you are a person who wants justice in case but I don’t see the point of all your inputs in this.you see practically missing the point of amiels death.we don’t need to go to the courts we need new policies for safe traffic flow in public places.I’m sure you’ll agree that amiel is not the first casualty in such a freak accident. We need change. I don’t see the point lingering on the personal trashing of ms Theresa torres laki counts. I don’t see the point affirming you know her ex husband and her family be dragged into this mess. It doesn’t solve anything and it never help anyone so stop and think before you put comments. What’s wrong if she did not cry do you think crying incessantly proves she is not suffering. Filipinos watch too much telenovelas that’s why they want such a scene. Hey don’t you think alcantara’s use all their money to feed the media for the hype. Come to think of it when someone without such power and money got hit by a cAr which I know kinds happens a lot. They just stay on tv for a day not everyday for a month so why is such a hype. Stop digging for dirt let’s stop and move on. You want info here are the facts. Theresa is also suffering as well her kid who study in ateneo. Mr and mrs alcantara lost amiel we all know how they miss their son. Both parties lost. No one is happy now can we all move on and dwell on how to make arectraffic schemes in public places safe.let us not put amiel’s death to waste but use it to learn and move. That is why our country never progresses becausebwhen an accidentvhappen we want the melodrama and politicking than sit down and think of solutions. Let’s start and think of keeping are kids safe in school.why not start with pedestrian lanes and drop off lane and pick up lanes. Now I challenge all bloggers suggest traffic policies than adding injury to insult.

A lot of us have been wounded, one way or another,by this tragic accident, yes,I said accident because no one would have wanted this to happen. What happened was so painful to both families. Both families are suffering, maybe in different degrees of pain or maybe in the same way,we don’t know. What we know is that we are also hurting, those who don’t even know anyone of them. Can you imagine how much more pain and hurt those two families are feeling right now?I can’t and I dare not assume that I know how they must be feeling right now. Some of us nga get emotional, pano pa kaya sila…let’s not blame both families if they do get emotional,if they try to hide their faces,if they don’t smile on the cameras,if they use their resources to get justice,if they show no remorse,if they show no mercy..whatever..it’s hard to be in their shoes..we don’t know how we would react given the same circumstances,God forbid.
I do my share of helping by praying for both families,to help them heal,in time…
For Amiel,I always pray that you’re happy in the arms of our Heavenly Father:-)
