we are posting here a comment from a reader, solar.

we will be filling up this post with updates once we get them from any member of the alcantara family.

Thanks for the reply. Do you think Amiel’s uncle (Doc Martin ? ) who has posted notices in Wawam can be requested to give Wawam readers updates on the case the Alcantara family has filed against the driver of the van ? We also need to see justice for Amiel served from that end.

ipaalam sa lahat na meron pang “unfinished business” sa ateneo grade school at hindi pa ito nakakalimutan ng mga magulang sa AGS. ipakita na maaring nag-umpisa na ang summer vacation, ngunit hindi ibig sabihin nito umpisa na ng paglimot ng unfinished business sa AGS.

theresa torres laki’s arraignment postponed to april 17

today’s scheduled arraignment will not push through and has been re-scheduled to april 17 instead. it was re-scheduled to give the parties time to prepare as the court has approved the consolidation the 3 cases filed against laqui under one court.

on the name of the suspect – the real name of the suspect was discussed in open court. torres is her maiden surname, while  laki is her marriage surname.

tomorrow, march 20, theresa torres, the suspect in the amiel alcantara death will be arraigned in judge jose bautista’s court in quezon city. the arraignment was originally scheduled last week but was move to tomorrow after the alcantara’s lawyers moved to amend the charge against torres.

Victim’s family wants homicide raps vs driver

MANILA, Philippines – The family of the Ateneo grade school student who was killed after he was hit by a van on campus asked a Quezon City court Thursday to upgrade the charges against the driver to homicide from reckless imprudence resulting in homicide.

“Their beloved Amiel was killed willfully through the deliberate unlawful act of accused Ma. Teresa Songco Torres. She should therefore be indicted for homicide,” the lawyers of Jose Fernando Alcantara – father of the victim, 10-year-old Julian Carlo Miguel “Amiel” Alcantara – said in their seven-page motion to Judge Jose Bautista Jr. of the Quezon City Regional Trial Court Branch 107.

“We want it to be upgraded to homicide because we believe there was an intent to kill. It’s up to the accused to prove that it was not intentional,” one of the lawyers, Rafael Aquino, said.

Based on the lawyers’ motion, Torres, also known as Ma. Teresa Torres-Laqui, was driving at more than 25 kilometers per hour when she hit Amiel.

“The actuation of accused in slamming her van’s accelerator to the floor in the manner of a car in a drag race toward the direction of Amiel was certainly willful and deliberate as there is no way that it could have stemmed from an inexcusable lack of precaution on her part which is the definition of reckless imprudence,” they said.

Homicide, Aquino pointed out, presumes an intent to kill on the part of the accused, while reckless imprudence does not.

“How would you explain that she was driving at such a high speed …na parang kapabayaan lang (that it was just negligence?)” he asked. Torres was set to be arraigned Thursday but this was reset to March 20.

last march 12’s hearing of the amiel alcantara death case, judge jose bautista called pepe alcantara, amiel’s dad and theresa torres, the suspect in the death of amiel was called into the chambers of the judge to talk face to face.

this is how the philippine daily inquierer reported it:

During a closed door meeting in Bautista’s office afterward, Torres asked the boy’s father to forgive her.

“She asked for my apology. I asked her if she has forgiven herself. She only smiled a bit and did not answer,” Alcantara told reporters, adding they were bent on pursuing justice for his boy.

on the amiel alcantara death — the alcantaras: to forgive torres? the torreses: our sympathies?

there are two questions that have been appearing in this blog in many other posts. i thought i would open this post so that we can collect all the responses here for a better appreciation of the points and a good discussion.

this blog is very lucky as almost everyone who post here are very decent and mature posters. the views expressed here are very good reads and contain gems and good insights. i understand the topic i am opening here can be controversial but i hope common sense and decency will prevail and we will get good reactions here.

these are two questions:

  1. The Alcantara Family Forgiving Theresa Torres. what do you think on that one? should there be forgiveness now? if the alcantaras have not done so – can you empathize with that? agree with it? understand it? is it easy to do? can you blame them for not being able to forgive? when should they forgive? what is forgiveness? where do you find the strength to forgive someone who has caused the death of your son? what do you think?
  2. The Sympathy We Give To Theresa Torres. we all know theresa torres is the other party involved and was the cause of death of amiel. sometimes we forget, but we should remember torres is also a member of the ateneo community. she also has a son/s studying at the ateneo. in fact she has  a son who is in the same grade as amiel. torres is also suffering and in pain. the guilt of being the cause of death of a child  must be overwhelming and consuming.  and what about her son who is also in grade 4? think of the feelings, shame, horror, fear and anger the son must be feeling now. he has a mother who caused the death of someone in his own grade. how can he face his classmates? what sort of ill feelings does he have against his mother? point is the torres family is also suffering. where are you on this? your thoughts?

I post this as an observer during the arraignment proceedings held this morning, 12 March 2009 at Branch 107 at the QC City Hall of Justice. I am not a lawyer and do not pose as one. I am a mere observant and commentator.

The scheduled arraignement began at 8:36am. The judge entered and all were asked to rise. Two other cases where first heard then finally our much awaited case was on by 9am. As in any other case, the complainant and defense are asked to identify themselves. I am surprized how the accussed Mrs. Torres deliberately softens her voice and tries to misleads the court with regards to her name. The case was filed against her on March 25, 2008 and she then gave her name as Ma. Theresa Songco Torres. When asked by the judge questions (just re-phrasing the previous identity question) she says something else. She says she is Ma. Theresa Torres Laki. The judge, perplexed by her soft voice asks her counsel to produce proofs of her identity such as passport and marriage certificates. She claimed to be a single parent yet she said she has a marriage certificate. Live in? A mistress perphaps of a known figure? Obviously, there was no Mr. Laki around to accompany her. There where two men sitting behind her, maybe a brother and/or father. I have information on Mr. Laki but I reserve this for my future postings. I have to make sure first.

As a non-legal observer of the proceedings, I asked myself. How can she not answer the judge outright by stating her full name? My prep nephew and niece can answer that quesiton in seconds, and they both have very looooong full names? What are you hiding from us Theresa? Why do you deliberately mislead the questioning right from the begining on the night after the killing of my nephew? Cant you face your accussers?

I would like to comment on the defenses’ motion to “quash” certain issues of the case. But I am not an authority on this. Just this for now. You may view my next videos of the arraignment on my youtube.com account. Search for mmnMoreno.

we heard that theresa torres, the ateneo mom who was involved in the tragic death of grade 4 student amiel alcantara will be arraigned in court this thursday, march 12.

we are guessing she is facing several charges – the death of amiel, the injuries on the nanny and the injuries on the two siblings of amiel. there can be others like the damages on the cars but the car owners and not the alcantaras are involved on that one.

the alcantaras are making an appeal to parents, drivers and students who witnessed the accident to come forward to give better light to the incident.

there are two families inolved here – the alcantaras and the torres. both families are grieving and in pain. torres  has a son who is also in grade 4 just like amiel was. her son has not gone back to school which is of course understandable.  

we need to look at this incident with an open mind as the wheels of justice turn and hopefully as justice is eventually served.

Family of Ateneo accident victim mulls hold departure order vs suspect

MANILA, Philippines – The family of Julian Carlo Miguel “Amiel” Alcantara, the Grade 4 student who was killed by a speeding van last week, said they would ask for the issuance of a hold departure order against the suspect to prevent her from leaving the country.

In her exclusive report in GMA News’ “24 Oras,” Mariz Umali said Amiel’s father, Jose Fernando, has never heard from suspect Ma. Theresa Torres after she posted bail last week.

“I don’t see her here so she must be hiding somewhere,” Mr. Alcantara said.

The Alcantaras’ counsels said they wanted to make sure that Torres would remain in the country for the investigation.

“We do plan to file a motion for the issuance of a hold departure order against Ms. Torres just to ensure that she stays,” said lawyer Rafael Aquino, one of the Alcantaras’ counsels.

The report quoted Torres’ legal counsel as saying that his client has no plans to hide or leave the country. He was also quoted as saying that Torres was traumatized by the accident but assured that she woud face the charges against her.
